Negotiation - Silence as a Tool

     I watched Popstar: Never Stop Never Stopping. While I won't say this movie is high art, it does provide some good laughs and some painful laughs.

     Aside from the humor, there is one particular scene which demonstrates the power of silence in a negotiation.

     At approximately, 1 hour and 5 minutes into the movie, the character Conner attempts to reconcile with his ex-band mate Lawrence. Lawrence is disgruntled with Conner because Conner won a Poppy award and claimed that he wrote the Catchphrase verse. Conner initially starts by saying that Lawrence can borrow the Poppy award to take some photos with it.  And, when met with Lawrence's silence, Conner slowly begins to admit the truth behind the Catchphrase verse.

      While negotiations can be described as finding a win-win situation that leads to a fair compromise, don't forget that not responding can be an effective negotiation tool.

Website - Does it work well on all devices?

     I recently received an email from Google asking me to test my website to see if it works well on all devices. 



By clicking on the link, I learned that according to Google, my law firm's website is mobile friendly, but slow on mobile devices and okay on non-mobile devices.

 

It appears this link is a variant on a different Google website development tool - PageSpeed Insights.

Corporate - An ounce of prevention

     There is an article in the NY Times about the state of a billion dollar business called Transperfect.

     The article is a cautionary tale concerning how two founders saved some money when they formed their business by not having their business relationship properly documented, and how that decision has cost them their business.

     When you are forming your business, it may seem like a good decision to save some money by not having your attorneys prepare your business formation documents. However, it isn't wise. Spending some money up front will invest the founders in the business and will clearly define your relationships, thus reducing internal disagreements.

     Similar to my earlier post, selecting a single trademark to use around the world is difficult.

     Q.  I saw this box of cereal in Europe.  To everyone in America, what about this image doesn't quite seem correct?



     A.  In America, the cereal is called Frosted Flakes.

Trademarks - Branding around the world

     Finding a trademark that works globally is important.

     Around the corner from where I used to live in New York City, there was a gelato place called GROM.  I recently was in Como, Italy and I encountered another GROM shop.  Yes, they were related and the gelato was awesome.

 

    Also, on that same trip, I was in Piacenza, Italy.  I encountered EATALY.  Yes, it too was related to  EATALY in New York City.

Daylight Saving Time ends in the US

     On Sunday, November 6th, the U.S. will end daylight saving time.  Thus, the number of hours between New York, NY and Europe will revert to its standard number of six (6) hours.

     If you recall, in 2007, the U.S. altered its observance of DST.  It moved the start forward from the first Sunday in April to the second Sunday of March; and it pushed the end back from the last Sunday in October to the first Sunday of November.
